1. General Agreement

These Terms of Service govern all freight transportation arrangements, rate quotes, brokerage services, and dispatch agreements entered into with A2Z Logistics Group ("A2Z"), headquartered at 77 Monroe Center St NW, Suite 400, Grand Rapids, MI 49503. By requesting a quote, booking a shipment, or tendering freight to A2Z, the customer ("Shipper") agrees to be bound by these terms.

2. Rate Quotations & Spot Validity

Spot market rate quotes provided via our website, email, or telephone are based on available carrier equipment, current diesel fuel surcharges, and market conditions at the time of calculation. Spot quotes are valid for a period of twenty-four (24) hours unless otherwise specified in writing. Dedicated contract rates are governed by independent written agreements executed by both parties.

3. Shipper Warranties & Cargo Preparation

The Shipper warrants that all goods tendered for transport are properly packaged, labeled, secured on pallets, and marked in compliance with applicable federal, state, and local transport laws. The Shipper is solely responsible for ensuring:

Declared cargo weights do not cause tractor-trailer combinations to exceed federal or state gross and axle weight limits (standard 80,000 lbs gross vehicle weight).
Accurate declaration of hazardous materials (HAZMAT) in compliance with 49 CFR regulations prior to dispatch.
Pre-cooling of perishable food goods prior to loading into refrigerated trailers.

4. Loading, Unloading & Detention Terms

Standard rate quotes include two (2) hours of complimentary loading time at origin and two (2) hours of complimentary unloading time at destination. Dwell time exceeding the two-hour allowance will incur detention fees at our prevailing standard hourly rate, provided the driver arrived within the scheduled appointment window.

5. Bills of Lading & Proof of Delivery

Every shipment must be accompanied by an authorized Bill of Lading (BOL). The BOL serves as a receipt of goods and must reflect piece counts, pallet numbers, trailer seal numbers, and delivery instructions. A clean, signed Proof of Delivery (POD) signed by an authorized receiver representative shall constitute prima facie evidence of complete and undamaged delivery.

6. Cargo Claims & Liability Limits

All cargo loss or damage claims are evaluated pursuant to 49 U.S.C. § 14706 (the Carmack Amendment). Notice of intent to file a cargo claim must be provided in writing within nine (9) months of the delivery date, accompanied by supporting documentation, commercial invoices, and inspection reports.

7. Governing Law & Jurisdiction

These terms and all transportation agreements shall be governed by, construed, and enforced in accordance with federal transportation law and the laws of the State of Michigan, without regard to conflict of law principles. Any legal action arising hereunder shall be instituted exclusively in the state or federal courts located in Kent County, Michigan.
